2. you and your means any person who accesses or uses the Website, purchases products from us, or requests services from us;
3. Products means jewellery, watches, accessories, gift cards and other goods offered for sale by us;
4. Services means services offered by us, including repairs, resizing, cleaning, custom jewellery, design services, quote services, valuation-related services, lay-by arrangements and customer support; and
5. Australian Consumer Law means Schedule 2 to the Competition and Consumer Act 2010 (Cth).
By accessing or using the Website, placing an order, creating an account, submitting an enquiry or requesting Services, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Website.
2. Other applicable terms and policies
These Terms should be read together with our:
1. Privacy Policy, available on the Website;
2. any product-specific terms displayed on a product page;
3. any promotional terms applying to a sale, discount, offer or event;
4. any lay-by, repair, custom design, quote or valuation-related terms provided to you; and
5. any delivery, returns, exchange or warranty policies published by us from time to time.
If there is any inconsistency between these Terms and any product-specific or service-specific terms, the more specific terms will apply to the extent of the inconsistency.
3. Eligibility to use the Website
You may use the Website only if you:
1. are at least 18 years old; or
2. access and use the Website with the consent and supervision of a parent or legal guardian.
By placing an order or creating an account, you represent that you have legal capacity to enter into a binding agreement.

The Website may contain information about jewellery, watches, precious metals, gemstones, diamonds, repairs, custom designs, prices, promotions, availability and other Products or Services.
We take reasonable care to ensure that information on the Website is accurate and current. However, to the maximum extent permitted by law:

2. images, product descriptions, colours, dimensions, weights and specifications may not always be exact;
3. gemstone and metal colours may appear differently depending on your device, screen settings, lighting and photography;
4. stock availability may change without notice;
5. prices, promotions and product details may be corrected or updated at any time; and
6. we do not warrant that the Website will be uninterrupted, error-free or free from viruses or other harmful components.
Nothing in these Terms limits any rights you may have under the Australian Consumer Law or any other applicable law.
5. Product descriptions, gemstones and precious metals
Product descriptions may include information about metal type, gemstone type, diamond characteristics, carat weight, design, dimensions, setting, finish and other specifications.
Unless expressly stated otherwise:
1. all weights, measurements and dimensions are approximate;
2. carat weights may vary within customary jewellery industry tolerances;
3. natural gemstones may contain inclusions, colour variations and natural characteristics;
4. gold, silver, platinum and other precious metal items may vary slightly in colour, tone, finish and weight;
5. handmade, customised or altered items may not be identical to images or samples; and
6. images are illustrative and may be enlarged or adjusted to show detail.
Any certificate, valuation, grading report or other document provided with a Product is subject to the terms, scope and limitations of the issuing party.
6. Prices
All prices displayed on the Website are in Australian dollars unless stated otherwise.
Unless expressly stated otherwise, prices include GST where GST is applicable.
Prices may change without notice. The price payable for an order is the price displayed at the time your order is submitted, subject to correction where there is an obvious error.
We reserve the right to correct pricing errors, typographical errors or omissions. If a pricing error affects an order you have placed, we may contact you to confirm whether you wish to proceed at the corrected price or cancel the order and receive a refund of any amount paid.
7. Orders
You may place an order through the Website or through another sales channel made available by us.
An order submitted through the Website is an offer by you to purchase the relevant Products or Services on these Terms.
We may accept or reject an order in our discretion, including where:
1. a Product is unavailable;
2. there is an error in the price, description or availability of a Product;
3. payment is not authorised or is reversed;
4. we reasonably suspect fraud, misuse or unlawful activity;
5. the delivery address is outside an area we service;
6. you have provided incomplete or inaccurate information; or
7. we are unable to fulfil the order for any other reasonable commercial reason.
A binding contract is formed only when we accept your order, including by issuing an order confirmation, receipt or dispatch confirmation.
An automated email acknowledging receipt of your order does not necessarily constitute acceptance of the order.
8. Payment
You must pay the full price for your order, including any applicable delivery charges, at the time of purchase unless we agree otherwise in writing.
We may accept payment by methods displayed on the Website, which may include credit card, debit card, electronic funds transfer, third-party payment services or other payment methods approved by us.
Payments made through the Website may be processed by third-party payment providers. Your use of those payment services may be subject to the third party’s own terms and privacy policy.

We may request additional information before accepting or dispatching an order, including identification, proof of address, transaction verification or other information reasonably required for fraud prevention or security purposes.
We may cancel an order where verification is not completed to our reasonable satisfaction.
10. Delivery
Delivery options, estimated delivery times and delivery charges will be displayed on the Website or confirmed during the ordering process.
Delivery times are estimates only and may be affected by stock availability, customisation, repairs, supplier delays, courier delays, public holidays, weather events, security checks or other factors beyond our reasonable control.
Risk in Products passes to you on delivery to the delivery address nominated by you, unless otherwise required by law.
Title to Products passes to you when we have received payment in full in cleared funds.
You are responsible for ensuring that the delivery address and contact details you provide are complete and accurate.
If delivery cannot be completed because you provided incorrect details, failed to collect the parcel, were unavailable to receive delivery or otherwise caused delivery failure, you may be responsible for any additional delivery, storage, return or re-delivery costs.
11. Click and collect
Where click and collect is offered, you may be required to collect your order from our store at:

You may be required to provide:
1. order confirmation;
2. proof of identity;
3. the payment card used for the order; and/or
4. any other verification reasonably required by us.
We may refuse collection if we are not reasonably satisfied as to the identity or authority of the person collecting the order.
12. Returns, exchanges and refunds
Your rights under the Australian Consumer Law are not excluded, restricted or modified by these Terms.
You may be entitled to a remedy under the Australian Consumer Law if a Product is faulty, not of acceptable quality, not fit for a disclosed purpose, does not match its description or sample, or otherwise fails to meet a consumer guarantee.
Subject to your rights under the Australian Consumer Law, we are not required to provide a refund, exchange or store credit if you:
1. change your mind;
2. choose the wrong size, colour, style or item;
3. find the same or similar item elsewhere at a lower price;
4. no longer require the Product;
5. damage the Product after purchase; or
6. fail to follow care, use or maintenance instructions.
For hygiene, security and customisation reasons, certain items may not be returnable for change of mind, including:
1. earrings and body jewellery;
2. customised, engraved, resized, altered or made-to-order items;
3. special order items;
4. items damaged by misuse, accident, improper care or unauthorised repair; and
5. items not returned with original packaging, certificates, receipts or accompanying materials.
Any return, exchange or refund request must be accompanied by proof of purchase.
We may inspect any Product before determining the appropriate remedy.
13. Consumer guarantees
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
For major failures with goods, you may be entitled to reject the goods and obtain a refund or replacement, or keep the goods and obtain compensation for the reduction in value.
For minor failures, we may provide a repair, replacement or refund in accordance with the Australian Consumer Law.
For services, where there is a failure to comply with a consumer guarantee, you may be entitled to have the service supplied again or to receive compensation, depending on the nature and seriousness of the failure.
Nothing in these Terms excludes, restricts or modifies any non-excludable statutory guarantee, right or remedy.
14. Warranties
Products may be supplied with a manufacturer’s warranty, supplier warranty or warranty document.
Any such warranty is in addition to, and does not limit, your rights under the Australian Consumer Law.
Unless expressly stated otherwise, warranties may not cover:
1. normal wear and tear;
2. accidental damage;
3. loss, theft or misuse;
4. damage caused by chemicals, cosmetics, perfume, chlorine, heat or improper cleaning;
5. damage caused by impact, bending, crushing or pressure;
6. loose stones or settings caused by wear, impact or lack of maintenance;
7. unauthorised repairs, resizing, alteration or modification;
8. failure to follow care instructions; or
9. variations inherent in natural gemstones, metals or handmade items.
You should retain your receipt and any warranty documentation.
15. Jewellery care
Jewellery and watches require proper care and maintenance.
You are responsible for using and caring for Products appropriately, including by:
1. avoiding impact, pressure, rough handling and exposure to harsh chemicals;
2. removing jewellery before swimming, cleaning, exercising or engaging in manual work;
3. storing jewellery safely and separately to avoid scratching or damage;
4. having settings, clasps, claws and stones checked periodically; and
5. following any care instructions provided by us or the manufacturer.
Failure to properly care for jewellery may affect warranty coverage and may reduce or exclude remedies where damage is caused by misuse, neglect or wear and tear rather than a failure to comply with a consumer guarantee.
16. Repairs, resizing and alterations
We may offer repairs, resizing, cleaning, polishing, setting, alteration and related services.
Before accepting an item for repair or alteration, we may inspect the item and provide an estimate or quote.
Unless otherwise agreed in writing:
1. repair and alteration timeframes are estimates only;
2. quotes may be subject to change if additional issues are identified after inspection;
3. old, worn, fragile, previously repaired or damaged jewellery may carry increased risk during repair or alteration;
4. we may decline to repair or alter an item if we consider it unsuitable or unsafe to work on;
5. you must collect repaired items within a reasonable time after being notified that they are ready; and
6. we may require payment before releasing repaired or altered items.
Where you provide jewellery, stones, watches or other items to us for repair or service, you warrant that you are the owner of the item or are authorised by the owner to request the relevant service.
We are not responsible for pre-existing damage, weakness, defects or deterioration in items provided to us, except to the extent caused by our failure to exercise due care and skill.
17. Custom jewellery and special orders
Custom jewellery, made-to-order items, special orders, engraving, bespoke design work, stone sourcing and other personalised Products or Services may be subject to additional terms.
Unless otherwise agreed in writing:
1. custom and special order items may require a deposit;
2. deposits may be non-refundable once design work, sourcing, production or ordering has commenced, subject to your rights under the Australian Consumer Law;
3. design specifications must be approved by you before production commences;
4. changes requested after approval may incur additional charges;
5. production timeframes are estimates only;
6. handmade items may have minor variations from drawings, renders, samples or images;
7. custom, engraved, resized, altered and special order items cannot be returned for change of mind; and
8. you are responsible for ensuring that all names, dates, text, sizes and specifications provided by you are accurate.
Where you provide images, sketches, design concepts, stones, metals or other materials, you warrant that their use by us will not infringe any third-party rights, including intellectual property rights.
18. Quotes and estimates
Any quote or estimate provided by us is valid for the period stated in the quote.
If no validity period is stated, the quote is valid for 7 days from the date it is issued.
Quotes may be subject to change due to:
1. fluctuations in gold, silver, platinum, diamond, gemstone or foreign exchange prices;
2. changes in supplier pricing;
3. changes to design, specifications, labour or materials;
4. additional work required after inspection; or
5. errors or omissions.
A quote is not binding unless accepted by us in writing and any required deposit or payment has been received.
19. Valuation-related services
We may provide valuation-related services or assist with arranging valuations through third-party valuers.
Unless expressly stated otherwise:
1. valuations are opinions based on information available at the time of assessment;
2. values may vary depending on market conditions, replacement costs, appraisal method and purpose;
3. valuation documents may be prepared by third-party valuers who are responsible for their own assessment; and
4. we do not guarantee any resale, insurance, replacement or market value unless expressly stated in writing.
20. Lay-by and customer schemes
We may offer lay-by arrangements, loyalty programs, customer schemes or other payment or customer arrangements from time to time.
Any such arrangement will be subject to the specific terms provided at the time the arrangement is entered into.
Unless otherwise stated, discounts, loyalty benefits, promotional offers and customer scheme benefits:
1. are not transferable;
2. cannot be redeemed for cash;
3. may be subject to expiry dates, exclusions and minimum spend requirements;
4. may not be used with other offers unless expressly permitted; and
5. may be amended, suspended or withdrawn by us where permitted by law.
21. Gift cards and store credits
If we issue gift cards, vouchers or store credits, they will be subject to the terms stated at the time of issue.
Unless otherwise required by law or stated in writing:
1. gift cards and store credits are not redeemable for cash;
2. lost, stolen or damaged gift cards may not be replaced;
3. gift cards and store credits may not be used to purchase additional gift cards;
4. expiry dates will apply only where permitted by law; and
5. we may refuse to honour a gift card or store credit if we reasonably suspect fraud, misuse or unauthorised use.
22. Promotions and discounts
Promotions, discounts, coupon codes, sale prices and special offers are subject to any terms stated at the time of the promotion.
Unless expressly stated otherwise:
1. promotions are available for a limited time only;
2. promotions are subject to stock availability;
3. discounts cannot be applied retrospectively to previous purchases;
4. only one coupon code or promotional offer may be used per order;
5. promotions may exclude custom orders, repairs, services, gift cards, lay-by items, special orders or selected brands; and
6. we may amend, suspend or withdraw a promotion where necessary due to error, fraud, misuse, stock limitations or other reasonable commercial reasons.
23. Website accounts
You may be able to create an account on the Website.
You are responsible for:
1. ensuring your account information is accurate, complete and up to date;
2. maintaining the confidentiality of your username and password;
3. all activity occurring through your account; and
4. notifying us promptly of any unauthorised access or security breach.
We may suspend, restrict or terminate an account if we reasonably believe that:
1. the account has been used in breach of these Terms;
2. the account has been compromised;
3. false or misleading information has been provided;
4. the account is being used for fraud, misuse or unlawful activity; or

4. the User Content is not defamatory, obscene, offensive, unlawful or harmful; and
5. our use of the User Content for the purpose for which it was provided will not breach any law or third-party right.
You grant us a non-exclusive, royalty-free licence to use, reproduce, modify and communicate User Content to the extent reasonably necessary to provide Products or Services, respond to your enquiry, process your order, prepare quotes, perform custom design work, conduct repairs or operate our business.
We may remove or decline to publish any User Content at our discretion.
26. Intellectual property
All intellectual property rights in the Website and its content are owned by or licensed to us.
This includes rights in:
1. text, images, photographs, graphics and product descriptions;
2. logos, trade marks, business names and branding;
3. jewellery designs, drawings, renders and concepts;

in the case of services, supplying the services again or paying the cost of having the services supplied again;
we are not liable for indirect, consequential, special or economic loss, including loss of profit, loss of revenue, loss of opportunity, loss of data or loss of goodwill; and
we are not liable for loss caused by events beyond our reasonable control.
This clause does not apply to the extent that liability cannot be limited under applicable law.
33. Indemnity
You indemnify us, our officers, employees, contractors and agents against any loss, damage, liability, cost or expense arising from:

2. your misuse of the Website;
3. your infringement of our intellectual property rights or third-party rights;

6. supplier or courier delay;

10. any other event beyond our reasonable control.
If such an event occurs, we will take reasonable steps to minimise its impact.

The remaining provisions will continue in full force and effect.

42. Governing law and jurisdiction
These Terms are governed by the laws of Victoria, Australia.
The parties submit to the non-exclusive jurisdiction of the courts of Victoria and the courts entitled to hear appeals from those courts.
